A relevant Bill on Amendments to the Law, 'On Public Self-Organisation Bodies' (appertaining to the Term of Office of a Public Self-organisation body) is under consideration in The State Building and Local Self-Government Committee.

 

The Bill (Reg. No.1444) creates a revised Clause 11 of this Law, acknowledging the Term of Office of a Public Self-organisation body, the procedure for termination of its operation, the term of election of PSB members, a procedure for changing the number of members and membership, a procedure for re-election of its members, the term for investing PSB with delegated authorities and the procedure for termination of said authorities, and consequences of a refusal of the delegated authority.

 

A new approach is envisaged for defining the Term of Office of Public Self-organisation bodies, i.e.: 'a Public Self-organisation body shall operate until its own authorities are terminated by the Local power (of the current or following Convocation)'.

 

According to the Bill, 'Public Self-organisation body members shall be elected for a term as determined by the meeting (conference) of residents, but no longer than for 5 years'.

 

The Sponsors of the Bill, The People's Deputies, V. Bondarenko, O.Semerak, and S. Podhorny, noted that after Termination of a Council's Convocation, the Public Self-organisation bodies actually terminate their operation and their funding is stopped. However, during the period of formation of a Local Council of a new Convocation, local matters also need to be resolved. As a rule, The People's Deputies emphasized, these matters relate to maintenance of buildings, streets, and micro-districts, rubbish collections and disposal, security of entrances, water and heat supplies, etc. Therefore they consider it inexpedient to terminate the operation of Public Self-organisation bodies during the period of formation of a new council.

 

The People's Deputies believe that the passing of this Bill will contribute to the continual fulfillment of Local Self-government functions in territorial communities.
